Director of Intellectual Property, Asia Pacific

Location: Asia-Hong Kong-Wan Chai-Causeway Bay

SUMMARY
The Director of Intellectual Property is responsible to advise and support the Brands of the Luxury and Sport & Lifestyle Division (“the Brands”) in intellectual property and brand protection matters in the Asia Pacific region. The Director Intellectual Property is responsible for general oversight and management of all Brand Protection and Enforcement strategies, prevention and investigation of all grey marketing, counterfeiting and related corporate governance issues. The roles and responsibilities of the Director Intellectual Property include, but are not limited to the following:
ESSENTIAL DUTIES AND RESPONSIBILITIES
  • Establish and lead an in-house team of IP professionals in the Asia Pacific region to protect and enforce the Brands IP
  • Advise and support the Brands in all IP and brand protection and enforcement matters
  • Collaborate with the Group IP Director and the Brands Head of IP to design and implement effective anti-counterfeiting and brand protection strategies and initiatives and set KPI’s
  • Maintain a strong and cost-effective regional portfolio of private investigator and law firms and leverage on the size of our Group by negotiating Group discounts 
  • Establish and maintain excellent working relationships with the relevant law enforcement
    agencies, customs and other supporting agencies and organizations
  • Develop and conduct trainings for the relevant authorities how to identify counterfeits and product imitations of the Brands
  • Identify and map IP risks for each Brand in the region
  • Perform regular market surveys to identify the level of IP infringements per Brand
  • Monitor IP infringements on the internet and coordinate brand protection activities accordingly. Collaborate with our global IP teams on these issues
  • Manage and assist on IP civil/criminal litigations and Trademark prosecutions, liaise with outside counsels and Brands IP legal teams on strategic litigation planning
  • Issue cease and desist letters against IP infringer
  • Familiarize yourself with the Brands products and become the subject matter expert on all security features
  • Prepare regular activity and case reports for each Brand
  • Supervise and maintain an IP enforcement database
  • Discuss and agree with Brands on the respective IP budget for the region and manage the budget efficiently
  • Prepare necessary documentation for intra-group charges
  • Produce, maintain and deliver an educational and training awareness program for
    Group employees in Asia Pacific.
  • Analyze industry trends and identify any changes required
  • Collaborate with governmental and non-governmental organizations, trade associations and competitors to ensure the highest efficiency and effectiveness of our brand protection programs
  • Play an active role in representing the Group in non-governmental organizations and on IP summits and workshops
  • Establish an excellent working relationship with internal departments such as corporate communications and institutional affairs

Qualifications

QUALIFICATIONS
  • BA required; Postgraduate Degree in legal and/or business
  • Minimum of 10 years’ relevant experience in similar position with sizeable MNC and/or consultancy/law firm
  • Strong judgement
  • Entrepreneurial mindset with a sense for reasonable cost-benefit ratio
  • Outstanding analytical abilities; a demonstrated ability to work independently
    and complete cases/projects in a timely manner
  • Strong organization, presentation, communication, writing and interpersonal skills
    are required
  • High level of commitment, motivation and team orientation
  • High integrity and resilient in the face of challenges
  • International work experience is a must
  • Excellent command of written and spoken English and Mandarin Chinese preferred
  • Proficiency in MS Office applications
  • Appreciation of different cultures
